On December 9 2013 the TAXI SERVICES COMMISSION advised the media and others and only then the license holders of changes to licensing conditions. The TSC also advised each of the 950+ license holders that they could appeal under certain sections of the ACT.
Some license holders chose to do this and applied to VCAT.
The TSC turned up at VCAT with taxpayers money to advise that VCAT did not have jurisdiction even though the very same TSC advised license holders of their rights to appeal.
On March 12 2014 VCAT has ruled that they indeed do have jurisdiction.
Not satisfied with this the TSC appealed VCAT's ruling to the SUPREME COURT and lost. The SUPREME COURT decision of AUGUST 1, 2014 was scathing of the TSC.
License holders are happy because now they will get a chance to negotiate better outcomes. The TSC has yet again proven that they are not quite sure of what is going on.
The hire car industry holds what are known as commercial passenger vehicle licenses and the cars display special number plates beginning with VHA, VHB or VHC. This end of the market is professional and legal.
The TSC should have looked ta cleaning up that part of the industry that operate without these number plates and in many many cases do so without correct authority. The TSC and its predecessor, the VTD, has failed to enforce its own legislation and regulations for many years and are now under scrutiny themselves
