New laws passed from mid 2011 mean that a new Mid Range level of drink driving is being used for sentencing purposes, Pine Rivers Traffic Lawyer Jamie Whitehead provides.
Previously a reading between .05 and .15 would be counted as being within the 'General Range' and anything above .15 was counted as High Range. An offence over .15 is known as 'Under the Influence of Liquor'.' "You could count on a minimum mandatory period of dsiqualfication of 1 month in some circumstances, specifically those of a first offence and low reading." Mr Whitehead provided.
Since the 1st of July, 2011 a drink drive detected in the range between .10 and .15 is counted as being in the 'Mid Range' and automatically invites 6 Months Disqualfication upon a plea of guilt being entered at Court.
" A client of mine recently dealt with at the Pine Rivers Magistrates Court for an offence of driving with a reading of .119 at Albany Creek meant that regardless of the facts provided in sentencing, the court had to impose the six months."
