A recent enquiry at Pine Rivers Traffic Lawyers revealed some confusion over the issuing of infringement notices by bodies such as the Qld Police Service. Solicitor Jamie Whitehead explains, "If a person receives an infringement notice for, say a traffic offence and the details recorded such as name, address, time and date, offence type, registration details on the car, location etc may be incorrect, the issuing officer has the power under the law to cancel that notice and reissue a new one."
The power comes from the State Penalties Enforcement Act 1999 which, as long as a letter of notification is sent to the person that the infringement notice was issued, then the original is no longer recognised.
" The prosecution also has the power to seek leave of the court to amend certain particulars on the infringement notice. Offences such as drink drive, suspended or disqualfied or applications for a work licence or special hardship order cannot be fixed in this way.
