GYMPIE MALE SENT TO PRISON FOR DISQUALIFIED AND DRINK DRIVING - LAWYER

A 24 year old male was sentenced to 3 months jail after pleading guilty at the Gympie Magistrates Court to driving under the influence of liquor .0168% as well as driving whilst disqualfied. The male had previously been issued with a suspended sentence for a period of 2 years after he drove disqualified 3 times in a period of 1 month.
Solicitor Jamie Whitehead of Sunshine Coast Traffic Lawyers submitted that his client had not been diagnosed with a mental condition until well after the original offences. It was submitted that the male suffered from a physical injury in his back and was an alcoholic in an effort to treat the pain. This in turn made him reliant on drink which led to its own social issues.
Mr Whitehead argued that the law made allowances for suspended sentences to be extended where it would be unjust to sent a person to jail. It was argued that his client had actively participated in his own rehabilitation via completing a mining induction course as well as medical treatment for bi polar and pain. Mr Whitehead also submitted that his client was not a repeat drink driver and as such should not be punished and sentenced to prision for drink driving offences.
The magistrate advised that a callous disregard for the law could not be ignored and that the male must go to jail in order to send a clear message to the community.
Police also requested that the males car be confiscated permanently under the vehicle impoundent legislation. It was submiited that the car was already at the wreckers after an incident following the males arrest and as such the impoundment order application was withdrawn by the police prosecutor.
