An examination of your application will occur 3-4 months after the date of submission. Your examiner is assigned by IP Australia. Their job is to review your application to unearth potential objections, ensuring that it complies with trademark legislation, identifying similar marks, and ensuring that your mark is truly distinctive. In the case that the examiner raises objection, you will receive an ‘adverse report’ detailing the grounds for rejection. You will have the opportunity to respond to this report, as well as a time frame in which to remedy the issues. Your application can only proceed on to registration once your examiner has approved your changes. You can contact your examiner or a trademark professional for assistance in responding to adverse reports. If your examiner finds no grounds for objection, your application moves on to a 3-month period of opposition. During this time, other parties can object to your mark being registered: though it is rare to receive opposition at this stage of the registration process.
