Menancing Driving Charges.
This is one of the most serious traffic offences a driver can be charged with.
It can carry a term of imprisonment, fines and loss of licence.One of the important things to be aware of is often the Police will also charge a driver with Negligent Driving.
You cannot be charged with both offences stemming from the same event.
The Police are only permitted to proceed on either Menacing Driving or the Negligent driving charge not both
Many Police do not seem to be aware of this legislation.
The other fact that is often forgotten by Police is that they must inform you of your rights to remain silent.
Police may ask you for your name and address and ask who was the driver of a motor vehicle owned by you.
They cannot once they believe that you may have committed an offence continue to question/interview you without informing you that you do no need to say or do anything unless you wish to do so, and that anything you say may later be used in court as evidence.
